At FASHION PÉREZ all products are covered by the legal guarantee of conformity provided by Directive (EU) 2019/771, Romanian Government Emergency Ordinance no. 140/2021 and the consumer protection rules applicable in the customer’s country of residence.
1. WHAT THE GUARANTEE COVERS
The guarantee covers any lack of conformity of the product with the contract, such as manufacturing defects or products that do not match the description, quality or features stated on the website.
2. GUARANTEE PERIOD
The legal guarantee of conformity lasts three (3) years from delivery of the product.
During the first two (2) years, any lack of conformity that appears is presumed to have existed at the time of delivery, unless proven otherwise.
3. CONSUMER RIGHTS
In case of lack of conformity, the consumer may choose between repair or replacement of the product, unless one of them is impossible or disproportionate. Where neither is possible, or they are not carried out within a reasonable time, the consumer may request a proportionate price reduction or termination of the contract with a refund.
4. COSTS
Bringing the product into conformity is free of charge for the consumer. The costs needed to bring the product into conformity, in particular shipping, labour and materials, are paid by the seller.
5. HOW TO CLAIM THE GUARANTEE
Write to info@fashionperez.com stating the order number, a description of the problem and, if possible, photographs of the product. We will tell you the steps to follow.
6. EXCLUSIONS
The guarantee does not cover damage caused by improper use, normal wear and tear, accidents, failure to follow care instructions, or alterations made by the customer or third parties.
7. RELATIONSHIP WITH THE RIGHT OF WITHDRAWAL
The legal guarantee of conformity is independent of the 14-calendar-day right of withdrawal, which allows products to be returned without giving any reason (see our Returns and Refunds Policy).
8. DISPUTE RESOLUTION
If you are not satisfied with our answer, you can contact the Romanian National Authority for Consumer Protection (ANPC – www.anpc.ro), the consumer authority of your country of residence, or the competent courts.
